This Software is copyright 1990-2006 with all rights reserved by Pesco International. The distribution and sale of this Software are for the exclusive use of the original purchaser only. Single user versions are for use exclusively on a single computer, at one site at any one time. Multi-user or Local Area Networks (LAN) versions are for use on an unlimited amount of workstations linked to one server housed within the same building as the workstations. The loading of Multi-user or LAN on other servers is strictly prohibited. Unauthorized copying, duplicating, selling, or otherwise distributing the Software is a violation of Federal Copyright Law.

USE OF THIS PRODUCT CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS AND AN AGREEMENT TO ABIDE BY THEM. The original purchaser is granted a personal, non-exclusive, non-transferable license to use this Software under the terms stated in this Agreement and in any case ONLY on a single computer or server if a Multi-user or LAN is purchased, at one site at any one time. The purchaser agrees that it is the purchaser’s responsibility to insure that all hardware is compatible with PESCO’s software. The purchaser further agrees to insure that all networks are capable of supporting the amount of workstations accessing PESCO’s software at any given time. You may not assign or transfer the Software or this license without the express written consent of Pesco International. Any attempt to sublicense, assign, or transfer any of the rights, duties, or obligations hereunder is void. You may not copy, modify, alter, electronically transfer, lease or rent the Software or this Manual. The license is effective until terminated. You may terminate it at any time by destroying the Software and Manual. It will also terminate if you fail to comply with any term or condition of this Agreement. You agree upon such termination to destroy the Software and Manual. If the license terms are not acceptable, return the unused package to the original seller for a refund pursuant to their sales terms.

Pesco International will not be liable for special, incidental, consequential, indirect, or any other damages, even if our agents or we have been advised of the possibility of such damages. This means that Pesco International is not responsible or liable for damages or costs incurred as result of loss of time, loss or destruction of data, loss of profits or revenue, or loss of the Software's use. In addition, Pesco International is not responsible or liable for damages or costs incurred in connection with obtaining substitute software, claims by others, inconvenience, or any other costs.

Additional statements by agents, employees, distributors, and dealers of Pesco International do not constitute warranties by Pesco International, do not bind Pesco International, and should not be relied upon.

The laws of the State of New York govern this Agreement (except federal law governs copyrights and registered trademarks). If any court having jurisdiction deems any provision of this Agreement invalid, that particular provision will be deemed deleted and will not affect the validity of any other provision of this Agreement.
